Zoning Board of Appeals Minutes September 12, 2007
MEMBERS PRESENT: Peter Conner, Robert Richard, Michael Main, William Keohan, David Peck, and Marc Betti.

Mr. Conner called the meeting to order and explained procedures for the evening.  

CASE NO. 3383R – EGV, LLC – COMMERCE WAY

Sitting: Peter Conner, Robert Richard, William Keohan, Michael Main, and David Peck.

Mr. Richard read the legal advertisement into the record.

Attorney Serkey, representing the petitioner, said that in September 2006, two members of the Board had problems with the circulation on the property.  The new plan is designed to address those objections.  The traffic circulation on site will be improved.

Mr. Shaw, Associated Engineers, said during busy conditions you could not circulate around the building and would have to cut through the pumps.  The curve will be widened the menu board will be moved forward 35’ into the driving lane.  Personnel will be added.  Four parking spaces will be removed along the side of the building. Exit conditions stay the same.

Mr. Richard asked the petitioner if he looked into making the traffic one way for the Dunkin Donut and car wash cue.  

Mr. Shaw replied that he did not.

Mr. Vercollone, property owner, said that 12 to 15 cars per hour go through the carwash.

Mr. Shaw said that exiting at the light is the safest.  NSTAR said that the license would be issued for that configuration.  Flexible lane markers can be used and the curb will be flattened. Two parking spaces will be removed.  There will be no net loss in parking spaces.   

No public comment was offered.

A long discussion ensued regarding the plan.

Mr. Peck made a motion to continue this hearing to September 19, 2007 at 8:30 p.m.

Mr. Main seconded.

Unanimously continued.


CASE NO. 3305R – DANIEL D. SILVA  – TAYLOR AVENUE

Sitting: Peter Conner, Robert Richard, William Keohan, David Peck, and Michael Main.

Mr. Richard read the legal advertisement into the record.

Attorney Caruso, representing the petitioner, referred to the affidavit of Daniel Silva on file in the ZBA office. The judge has remanded this case back to the Board to determine if the dwelling with the deck is substantially more detrimental to the neighborhood that the dwelling without the deck.

Mr. Peck made a motion to approve Case No. 3305R with the original four conditions as stated in the Planning Board recommendation.

Mr. Keohan seconded.

CASE NO. 3439 – SECURED REALTY INC.  – STATE ROAD – Continued from August 1, 2007

Sitting: Peter Conner, William Keohan, David Peck, Robert Richard, and Marc Betti.

Attorney Angley, representing the petitioner referred to a written presentation on file in the ZBA office.

Mr. Shaw, Associated Engineers, said there will be parking in both the paved and unpaved areas.  There is adequate parking.  To meet the grade 50,000 cubic yards of material need to be removed from the site.  There will be an on site sewerage disposal system.  

Mr. Hensen, Registered Landscape Architect, said the entrance will have a neighborhood feel.  The new design will be a low rise shorter building.  The lower level is an interior parking garage.  The units are moved back from the street.  Each unit will have a driveway with garage.  The retaining wall will be stepped with planting in between.  Sixteen townhouse units are proposed.  The buffer is enhanced to White Cliffs.  The lighting will be lower level in the residential area.  All lighting will be under 20’.  There will be a sidewalk in front of the retail on State Road.

Mr. Müller, P. E., said the traffic study was done in January 2006.  Improvements will be made to the southerly drive-way.  Sidewalks will be installed on State Road and Old County Road.  The vegetation will be maintained annually.  The intersection at Herring Pond Road is the most dangerous.

Attorney Angley asked the Board to continue the hearing to a date convenient to the Board.
